Through Resolution 060 of 2020 (the "Resolution"), Energy and Gas Regulatory Commission ("CREG") adopted transitional measures regarding the implementation of deferred payment of invoices for the supply and transportation of fuel gas through networks, by marketing companies serving residential users in strata "estratos" 1, 2, 3 and 4, pursuant to Article 3 of Decree Law 517 of 2020, and in accordance with the provisions of Resolution CREG 059 of 2020.
In accordance with the Resolution, producers-marketers, transporters and marketers of fuel gas through networks are obliged to offer marketers of fuel gas through networks which provide services to residential users in strata “estratos” 1, 2, 3 and 4, a deferred payment scheme for the payment of invoices issued in the months of April and May of 2020, which must include at least the conditions defined in this Resolution and the procedure indicated therein (see article 3 of the Resolution). In contrast to the other strata, there is no obligation to implement the deferred payment scheme, but the Resolution gives companies the freedom to do so.
Likewise, this Resolution establishes the manner in which the interest rate applicable to such deferred payments shall be calculated and a grace period for the initiation of the payment of the deferred amounts and their financial cost. Such grace period shall be of two (2) months as of May 30, 2020, date on which the sanitary emergency declared as a consequence of Coronavirus Covid-19 ends, according to Resolution 385 of March 12, 2020 of the Ministry of Health and Social Protection.
