This Circular is addressed to the providers of the public utilities of water, sewerage and sanitation that are within the scope of resolutions CRA 911 of 2020, CRA 915 of 2020, as amended by Resolution CRA 918 of 2020 and CRA 916 of 2020.

It seeks to address the concerns about the provision of public water, sewerage, and sanitation services on the following resolutions, namely:

  • CRA Resolution 911 of 2020:

o    Transitional regulatory measures were established for the water and basic sanitation sector, derived from the emergency declared by the National Government due to COVID-19.
o    These measures will be implemented by the time the health emergency caused by the Coronavirus COVID-19 is declared by the Ministry of Health and Social Protection under the Resolution 385 of 12 March 2020, extended by the Resolution 844 of 26 May 2020.
o    Consequently, all the measures established in this resolution shall be understood as extended until the term established by Resolution 844 of 2020 or those that modify or replace it. 

  • Resolution CRA 915 of 2020

o    Modified by CRA Resolution 918 of 2020.
o    Establishes the transitional regulatory measures for deferred payment of bills for domestic water and sewage services and public sanitation services, within the framework of the emergency declared by COVID 19.
o    These measures should be understood as a regulatory development of the provisions established on the Legislative Decrees 528 and 580 of 2020. 
o    Therefore, any reference to the Economic, Social and Ecological Emergency must be understood as the emergency declared by the Decree 417 of 2020. While any reference to the health emergency must be understood as the health emergency declared by the Ministry of Health and Social Protection, through the Resolution 385 of 2020, extended and modified by the Resolution 844 of 2020, or the one that modifies, adds or substitutes them.

  • Resolution CRA 916 of 2020

o    Modifies paragraph 4 of Article 38 of Resolution CRA 720 of 2015, which had been modified by Article 1 of Resolution CRA 912 of 2020, establishing that due to the health emergency declared by Resolution 385 of 2020 of the Ministry of Health and Social Protection or the one that modifies, adds or replaces it, the productivity factor will not be applicable from the entry into force of Resolution CRA 912 of 2020, but from the billing period following the end of the health emergency.
o    Considering that the health emergency declared by the Ministry of Health and Social Protection was extended until August 31, 2020, this is the date to be considered for the purposes of Article 1 of this resolution.
