The Communications Regulatory Commission (CRC) issued Resolutions 5951 and 5952 of 2020 implementing measures aimed at telecoms and TV services providers under the COVID-19 emergency.
In Resolution 5951, the CRC authorized internet providers to prioritize traffic to (i) content or applications related to health services, (ii) government and public sector websites, (iii) development of employment and education activities, and (iv) exercise of fundamental rights. Providers must inform the CRC about the reasons, the content subject to prioritization and the duration of the measure.
Resolution 5951 establishes that providers of telephone and internet access services and of pay-TV services cannot charge late-payment interests for nonpayment during the duration of the emergency. This does not imply the remission/waiver of amounts (capital) due for the provision of the service.
Through Resolution 5952, the CRC established that TV services providers do not have to comply with quality indicators. The CRC also deferred until May 31, 2020 obligations related with the measurement, calculation and reporting of quality indicators for mobile data services for 3G access technology, HFC analog cable TV, HFC digital, satellite TV and IPTV. Services providers must nonetheless guarantee the provision of services in a continuous and efficient manner.
