Law classifies Internet as an essential and universal public service

Law 2108 of July 29, 2021, expressly classified Internet access as an essential public utility in Colombia. Among the amendments and additions introduced by this law, four (4) stand out:

  1. Telecommunications networks and services providers ("TNSP") shall not suspend works of installation, maintenance and adaptation of networks required for the operation of this essential public utility and shall guarantee the continuous provision of the service. The above notwithstanding compliance with the duties and obligations of subscribers and users of the service.
  2. During states of emergency and health emergencies, in which Internet access must be guaranteed as part of the attention and mitigation of the emergency and its effects, TNSP must comply with additional rules for mobile telephony plans (voice and data). These rules are also applicable during six (6) months following the enactment of the law.
  3. License applications for the construction, connection, installation, modification, or operation of any equipment for the provision of fixed and mobile telecommunications services shall be decided by the competent public or private entity within one month from the date of their submission. If this term is not complied with, it may be understood that the answer has been positive.
  4. The Fund for Information and Communications Technologies will finance the development of lines of credit, promotion and strengthening of TNSP that provide access to retail residential fixed Internet access with less than thirty thousand (30,000) reported users as of June 30, 2020.
