Anti-deforestation regulation in force

On June 29th, 2023, the European Union Regulation concerning the placing on the Union market and the export from the Union of certain raw materials and products associated with deforestation and forest degradation entered into force.


This Regulation lays down rules on the introduction, placing on the market and export of products containing, fed, or processed using raw materials such as cattle, cocoa, coffee, oil palm, rubber, soya and timber. For such products to be placed on the market, marketed, or exported, they must meet all the following conditions: (a) be free from deforestation; (b) have been produced in accordance with the relevant legislation of the country of production, and (c) be covered by a declaration of due diligence.


Any natural or legal person who, during a commercial activity, places the relevant products on the market or exports them (hereinafter referred to as "operators") must exercise due diligence.


The information contained in the due diligence must be available and transmittable by electronic means and at least include (i) the collection of information, data, and evidence necessary to meet the requirements; (ii) risk assessment measures; (iii) risk mitigation measures.


By December 30th, 2023, Member States shall designate one or more competent authorities as responsible for compliance with this Regulation. 


Obligations for SMEs will begin on June 30th, 2025. For medium and large on December 30th, 2024.
