The Constitutional Court declares the unconstitutionality of Decree 558 of 2020, through which measures were adopted to temporarily decrease contributions to the General Pension System and protect pensioners under the programmed retirement scheme during the Economic, Social and Ecological Emergency.

This Decree sought to adopt measures in the General Pension System to provide greater liquidity to employers, employees and independent contractors. It also sought to protect pensioners under the programmed retirement scheme who receive a minimum monthly legal wage from a potential decapitalization of the pension savings accounts supporting the payment of their pension.

Although this news was reported by the Constitutional Court earlier today, the final judgment has not yet been published, so its effects and consequences for employers are unknown. This news will be expanded as soon as the Court clarifies these aspects and publishes the ruling.
