On December 24, 2020, the National Hydrocarbons Agency ("ANH") issued Agreement 09, through which Agreement 06 of 2020 is amended by adding article 35 and establishing that the holder of a Special Contract for Research Projects ("CEPI") awarded during the first round of the bidding process for the development of research projects on the use of multi-stage hydraulic fracturing technique with horizontal drilling in unconventional oilfields - FHPH ("CEPI Bidding Process"), may avail itself to the second round's CEPI minutes contract by submitting a written request before the ANH.
In this regard, it is worth mentioning that through Agreement 06 of 2020, the ANH’s Board of Directors established the contractor's selection regulations and the contractual conditions for developing research projects within framework of the Comprehensive Research Pilot Projects.
On the other hand, on January 6, 2020 the ANH issued Addendum No. 6 to modifying the terms of reference (“ToR”) of the CEPI Bidding Process. This addendum states the following:
- Economic and Financial Capacity: those interested in participating in the second round of the CEPI Bidding Process, who submit an application for a qualification within the first quarter of 2021 and do not have the audited Financial Statements of the last fiscal year or 2020, may accredit the referred capacity through its 2019 audited Financial Statements, duly accompanied by their respective notes.
In the event of a modification to the schedule in respect to the submission of the offers for the second round of the CEPI Bidding Process, after the first quarter of 2021, the interested parties must update the corresponding information by filling out form No. 12 of the ToR; otherwise, they may lose its qualification and thus the right to participate in the CEPI Bidding Process.
- Annex No. 1 of the ToR for the CEPI Bidding Process, so-called: "Instructions for Completing Forms and Commitments" is modified in order to establish that the figures to be included in the forms of legal capacity and financial-economic capacity that are not expressed in Colombian pesos, and that are not included in the weekly publication H10 of the Federal Reserve of the United States of America, shall be converted to US dollars by applying the exchange rate certified by the Central Bank of the proponents' country of origin. For the Argentinian peso case, the Communication Reference Exchange Rate "A" 3500 (“Tipo de Cambio de Referencia Comunicación “A” 3500”) (Wholesale), published by the Central Bank of the Republic of Argentina, must be applied.
