The Resolution No. 0839 of August 28th, 2023, issued by the MADS is intended to replace Resolution No. 0941 of 2009, representing a significant advance in consolidating environmental information intended to strengthen the decision-making process based on the principle of environmental planning.
Regarding the SIUR, the Resolution establishes that information related to the use and exploitation of Renewable Natural Resources will be managed within the SIUR. However, it will be the Institute of Hydrology, Meteorology, and Environmental Studies (hereinafter "IDEAM") that will administrate and provide the information supplied by the environmental authorities.
Additionally, the Resolution obligates all natural or legal persons holding Environmental Licenses, Environmental Management Plans, permits, concessions, and environmental authorisations for the use and exploitation of natural resources to register in the RUA.
Likewise, the resolution establishes that the information registered in the RUA must be associated with Environmental Compliance Reports ("ICA"), in cases where an Environmental License or the imposition of an Environmental Management Plan exists. This implies that the RUA will have a direct relation with the ICAs, where information confirming the environmental and socioeconomic management of the Project, Work, or Activity must be obligatory.
Finally, it is important to highlight that the RETC and the Obligatory Greenhouse Gas Emissions Report (hereinafter "ROE") are integral parts of the RUA. Therefore, establishments will not be required to report the information in an additional registry; rather, its completion occurs automatically as a result of processing the information recorded in the RUA.
