The main measures included in Resolution No.100-001101 of March 31, 2020, are:
• Restarts the terms and deadlines of jurisdictional and administrative actions at national and regional levels.
• Disciplinary actions’ terms and deadlines are still suspended
1. Online Hearings and Proceedings:
• The legal proceedings and hearings related to jurisdictional actions presented before the delegates for mercantile and insolvency proceedings will be conducted online through remote connection.
• Superintendence general and regional headquarters remain closed, but they will render online service when possible.
• If a party within a process has not access to online media, the hearing or proceeding will be postponed to ensure the right for defense.
• When the emergency ends, the Superintendence will enable conference rooms for people that did not have access to online media, but online proceedings may be preferred.
• To start online proceedings, the personal data of the parties will be obtained from the physical dossier.
• Notwithstanding the aforementioned, during the emergency, hearings or proceedings may be suspended if physical presence is required, or if the officer in charge deems is pertinent.
2. Service of Process
- The service of process will be online through the Superintendence website or user email.
- Personal Service of process regarding admission of an action is suspended, as well as terms of said proceedings. Terms and deadlines will continue the day after the emergency ends.
3. Suspension of terms and deadlines regarding reorganization agreement:
- The suspension applies during the preventive isolation. Terms and deadlines will continue the day after the emergency ends.
