Transport or transit

The Ministry of Transport may create differential zones for transport and transit, which shall consist of one municipality and or  groups of municipalities, where there are no transport systems co-financed by the Nation and normal provision of the public transport service is not possible under the following conditions:

  1. Rural Vocation
  2. Economic and/or geographical and/or social, ethnic or other characteristics of the territory.

Those who can request the Ministry of Transport to create the differential zone for transport are the mayors of the municipalities.

The Ministry of Transport may, by administrative act, create differential zones for transport and transit.

Features of the transitional operational regulations of the differential zones for transport and/or transit:

  1. Define transitional operational conditions of competence of the territorial authority in matters of transit and transport, for the provision of public transport services and / or transit.
  2. Duration not exceeding the term of the zone established in the act of creation of the differential zone.
  3. Its application will be exclusive for the differential zone

Procedure for the creation of differential zones for transport and/or transit and the issuance of special regulations:

1.    The mayor of the municipality shall submit to the Ministry of Transport the written request which it must contain:
1.1. Determination of the municipality
1.2. Justification for the creation of the differential zone for transport and/or transit
1.3. Preliminary proposal for the transitional provision of the public transport service and/or the provision of transit services. 

2.    Ministry of Transport has 3 months from the filing to determine if the following requirements are met:
2.1. There are no transport systems co-financed by the Nation in that municipality.
2.2. Special conditions are accredited that prevent the normal provision of the transport service.

3.    The Ministry of Transport has six months from the date on which it informs the applicant whether or not the differential zone has been created to issue the administrative act establishing the differential zone.

Procedure for the creation of differential zones for the provision of the school transport service:

1.    To provide a written document in which they explain the circumstances that prevent the normal provision of the school transport service, with a detailed description of the conditions in which the school transport service is being provided, in which it is related: 
1.1. Name and location of the educational institutions and venues where there are difficulties in the normal provision of the school transport service. 
1.2. Current enrolment by educational institutions and venues where there are difficulties in the normal provision of the school transport service. 
1.    The Ministry of Transport has 2 months to issue a document proving the conditions of the requested differential zone.

2.    The Ministry of Transport has 3 months from the date of application to determine if the following aspects are fulfilled:

3.1. That in that municipality there are no transport systems co-financed by the Nation
3.2. Special conditions which prevent the normal provision of service are accredited. 

3.    The Ministry of Transport has six months from the date of notification to issue the administrative act.

Control and monitoring of the provision of the transport service in the differential areas:
It is done by the mayor if it is within the jurisdiction of the municipality, without prejudice to the inspection, surveillance and control that corresponds to the Superintendence of Transport. 
When the differential zone corresponds to a group of municipalities, it corresponds to the Superintendence of Transport.
