On August 5, 2021, the Ministry of Labor Issued Circular Letter No. 47 with the guidelines on Covid-19 vaccination in the workplace.
Through this Circular Letter, the Ministry clarifies that it is not possible to demand the Covid-19 vaccine as a requirement to enter or remain in employment due to the refusal of its application, as this represents a violation of the employees ‘fundamental rights.
Based on the above, the Ministry provides the following instructions:
- The employer must promote its employees ‘vaccination, guaranteeing, encouraging, and promoting their attendance at the vaccination sites, even within working hours, granting the corresponding permits.
- Companies and employers must implement the biosecurity measures and protocols adopted through Resolution 777 of 2021 and other relevant regulations.
- The employer must take actions, implement mechanisms and establish biosecurity protocols for the protection of employees ‘life and health, adjusting the hygiene and safety measures at work to guarantee the development of labor activities in the workplace in safe conditions. To this end, the employer must establish mechanisms to mitigate the spread of Covid-19.
