Article 15 of Decree 381 of 2012 establishes that the Hydrocarbons Direction of the Ministry of Mines and Energy is responsible for determining the methodology to set the transportation tariffs by pipelines.
Article 57 of the Petroleum Code establishes that the Ministry of Mines and Energy will update and review, every four (4) years, the transportation tariffs resulting from the application of the methodology.
The current methodology for setting crude oil transportation tariffs by pipeline is provided in Resolution 72146 of May 7th, 2014. According to this resolution (i) each year or tariff period begins on July 1st and ends on June 30th; and (ii) the first working day of the quarter immediately prior to the beginning of the next tariff period, the tariff review process by the Ministry must begin.
in view of the foregoing and considering that on June 30th, 2023, the tariff period, and the four-years term ends, on April 1, 2023, the Ministry of Mines and Energy should initiate the process to update the tariff to be applicable to the tariff period that begins on July 1st, 2023, and ends on June 30th, 2027.
However, on March 3rd, 2023, the Hydrocarbons Direction published for comments a draft resolution establishing that since December 2022 the Ministry has implemented actions and procedures for the socialization and issuance of the administrative act that will establish a new methodology to set and review pipeline transportation tariffs. Therefore, the process of updating the tariffs will not begin in April, and the tariffs set for the period 2019 - 2023 will remain in force until the tariffs for the period 2024 - 2026 are set, according to the terms established by the new methodology to be issued.
