The Ministry of Work modified numerals 1 and 3 of Resolution 784 of 2020 as follows:
The following administrative measures will be implemented:
1. Set the suspension of the procedural terms in all procedures and actions of competence of:
- The Vice Minister of Labor Relations and Inspection
- Inspection, Surveillance, Control and Territorial Management Directorates
- Labor Risks
- The Internal Disciplinary Control Office
- The Territorial Directorates
- Special Offices
- Work and Social Security Inspections
Of the Ministry of Work.
This includes:
a. Preliminary investigations
b. Disciplinary complaints
c. Disciplinary administrative procedures and their resources
d. Arbitration court requests
e. Procedures managed through the general administrative procedure
f. Other administrative actions that require the calculation of terms
This measure implies the interruption of the expiration term as well as the statute of limitation of the different procedures carried out by the Ministry of Work.
The terms of the following actions are excluded from this suspension:
a. The actions carried out in the development of the preventive function
b. Verification procedures
c. Requests for authorization of collective dismissal and suspension of activities for up to 120 days
d. Preliminary investigations and disciplinary administrative procedures due to alleged violation of employees ‘labor rights directly related to the different measures adopted by the National Government due to the spread of Covid-19 and the declaration of the economic, social and ecological emergency
In the events in which it is required to end the terms suspension, terms will start to be counted on the next working day following the notification.
3. Suspend inspection visits, conciliation hearings, findings, and the execution of other duties that involve transportation or physical contact with users.
The aforementioned activities that have already been scheduled will be postponed. This communication will be informed to the parties.
Inspection and finding visits, and the development of other duties aimed at protecting employees´ labor rights directly related to the different measures adopted by the National Government due to the spread of Covid-19 and the declaration of the economic, social and ecological emergency are excluded from such suspension.
Generally, these procedures will be conducted by virtual means, except for those activities that must be carried out physically. For this purpose, public servants must have all the necessary personal protection elements to prevent Covid-19 spread.
Likewise, according to the Ministry of Work, all actions that must be notified during the economic, social and ecological emergency, will be made through the electronic mailbox authorized to each dependency to the email addressed provided.
Similarly, until the economic, social and ecological emergency remain, as well as the health emergency declared by the National Government, the Ministry suspended terms for the submission of all acts established in Circular Letter 014 of 2020 issued by the Ministry of Work and the National Apprenticeship Service.
The submission of documents for the recovery and collection of fines will be made within 3 months after the health emergency´s end.
Lastly, as per the Ministry, these transitional measures will be in force until the health emergency and the economic, social and ecological emergency remain.
