This circular is intended to:

  • Natural gas producers-marketers
  • Natural gas carriers 
  • Importers of gas 
  • Natural gas marketers

Although agents may contractually and regulatorily modify their supply and transportation contracts with respect to prices and quantities. These modifications must follow the principles of regulation, good faith, transparency and loyalty between the parties in accordance to Resolution CREG 080 of 2019. 

Therefore, the Superintendence of Domiciliary Public Utilities understands that the agents to which this External Circular Letter is addressed must:

  1. Attend to requests for modification of supply and transport contracts.
  2. Develop negotiation processes in order to mitigate the negative effects on end-user tariffs caused by the pandemic. 
  3. Document the decisions taken, including justifications.
  4. Avoid imposing unjustified conditions.
  5. Promote the search for alternatives that allow for the least possible impact on the end users of the domestic gas public utility during the emergency. 
  6. Avoid unjustified discriminatory treatment in the negotiation process
  7. To guarantee that the exercise of their subjective rights in the framework of the negotiations they are conducting is in accordance with the guidelines established in Article 95, paragraph 1 of the Political Constitution of Colombia and Article 830 of the Commercial Code.
