ANM publica términos de referencia para Planes de Gestión Social

The National Mining Agency ("ANM") published Resolution No. 263 of May 25, 2021 (the "Resolution"), which purpose is to adopt the modification to the terms of reference that set forth the parameters and criteria for the draft, presentation, execution, evaluation, approval and follow-up of the Social Management Plans ("PGS"). 

The Resolution complies with the pronouncements of the Constitutional Court in which it is established that the PGS must have as input: (i) the minutes of the citizen participation hearing resulting from the mining application process, (ii) the minutes of the concurrence held with the mayor or mayors of the municipality or municipalities where the mining title is located, and (iii) the titleholders must involve the national, departmental and municipal development plans in the construction of their PGS. 

In addition, the Resolution introduced an important change regarding the prioritization criteria within the terms of reference of the PGS for the large-scale mining concession contracts to be executed and perfected as from 2021: investments for the provision of domiciliary public services must be prioritized in the programs for the benefit of the communities located in the area of influence of the mining project.
 
Thus, the terms of reference for the PGS set forth a new vision of mining oriented to social construction that promotes local and regional opportunities and mitigates risks of social conflict.
