The main measures included in Resolution 12169 of the Superintendence of Industry and Commerce are:

  • The terms of administrative and disciplinary proceedings are suspended as of April 1st until the end of the emergency.
  • The exceptions to the suspension are: (i) proceedings related to human rights, specially habeas data; (ii) preliminary injunctions and new proceedings regarding consumer protection rights; (iii) technical regulations and legal metrology; (iv) new proceedings related to anti-trust practices regarding goods and services needed to address the emergency; (iv) in general, proceedings needed to solve the Coronavirus COVID-19 emergency.
  • Exclusions to suspension: (i) non-disciplinary proceedings that may be carried-on online (except renewal of distinctive marks and payment of fees regarding New Creations which are still suspended); (ii) Procedures related to current applications for merger control, if the required information needed to decide is complete.
  • The Superintendence complies with the deadlines to answer petition rights included in Decree 491 of 2020.
