The National Hydrocarbons Agency ("ANH") published the Addendum No. 15 to the Permanent Bidding Process ("PPAA"), by means of which it modifies certain provisions of the Terms of Reference of the PPAA in order to facilitate the processes of qualification and submission of proposals and counteroffers in the framework of the global health contingency caused by COVID-19 (the "Addendum 15").
Specifically, Addendum 15 modifies clauses 6.9 and 9.1 of the Terms of Reference terms of reference, as follows:
- The company interested in qualifying or in submitting a proposal or counteroffer that, due to the administrative difficulties that some countries are experiencing during COVID-19, it is not able to satisfy the requirement of apostille or legalization of public documents issued abroad, nor deliver them to the ANH within the term set forth in the schedule of the PPAA, must declare such situation under oath in the Letter of Submission of Documents for Qualification or with the Letter of Submission of Proposal or Counteroffer (as the case may be), to which the corresponding support and evidence of its assertions must be attached;
- The ANH will verify the information provided and, if it confirms the correctness of the statement, it will proceed to evaluate the documents submitted and to issue the declaration of qualification or acceptance of the proposal or counteroffer; and
- In any case, the company qualified by the ANH or the company whose proposal or counteroffer have been accepted by the ANH under the procedure described above, must comply with the requirement of apostille or legalization at least three (3) working days prior to the date established in the schedule for the publication of the final list of qualified companies or the list of proposals or counteroffers, under penalty of being understood to have withdrawn its request and, thus, lose its right to participate in the PPAA.
Likewise, with the aim to facilitate the submission of the documents, the ANH modified the submission protocol, allowing interested companies to submit the documentation corresponding to its qualification or the update of its qualification via e-mail to correspondenciaanh@anh.gov.co. For this reason, this e-mail address was included in all the forms and enabling documents.
Please bear in mind that companies may only submit the documents to obtain or update their qualification for the PPAA until August 31, 2020.
