Considering that the National Government, through Decree 328 of 2020, established the criteria and procedures to carry out the Integral Research Pilot Projects on unconventional hydrocarbons in a multi-stage horizontal drilling and hydraulic rock fractures technique ("PPII”), and that the National Hydrocarbons Agency (“ANH”) is in charge of negotiating, executing and managing contracts and agreements for the exploration and production of hydrocarbons in Colombia, the ANH, in compliance with the article 8 of the Colombian Administrative Procedure Code providing that authorities must to maintain available to all interested parties the complete and updated information, among others, of the specific regulatory projects and the information used to build them, in order to receive opinions, suggestions or alternative proposals, published the Draft Decree "By means of which Agreement 18 of 2004, Agreement 04 of 2005 and Agreement 21 of 2006, as well as Agreement 2 of 2017 are supplemented, in order to incorporate the Contracting Regulations for Exploration and Production of Hydrocarbons, the contractual elements that will allow the performance of Research Well Projects for the development of Integral Research Pilot Projects on unconventional hydrocarbons in a multi-stage horizontal drilling and hydraulic rock fractures technique - FH-PH” (the“ Draft Decree ”).

The purpose of the Draft Decree is to establish the conditions for (i) the determination and delimitation of the areas in which  PPII will be developed; (ii) the contractors selection that will carry out the PPII; and (iii) the special contractual terms that will be established for the execution of the PPII, as well as the obligations, guarantees, economic rights, monitoring procedures and contractual control, among others.

It is important to consider that such observations, comments and proposals shall be submitted in the editable Excel form for the reception of comments, which is available on the ANH website, where the Draft Decree is also published.
